Terms of Service

Welcome to Fractal Flow, a writing application provided by Perry Labs LLC, a Wisconsin limited liability company ("we," "us," or "Perry Labs"). These Terms of Service (the "Terms") govern your use of Fractal Flow (the "Service"). Please read them carefully.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Fractal Flow is an AI-assisted writing application designed to help novelists plan, draft, and revise long-form fiction. Features include world-building, timeline tools, AI brainstorming, AI-assisted editing, consistency checking, and document export. The Service relies on third-party AI providers to process inputs and generate outputs.

3. User Accounts and Responsibilities

You must be at least 13 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at support@fractalflow.ai if you suspect unauthorized access. You agree to provide accurate information when creating your account and to keep it current.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or to produce content that violates applicable law, including content that infringes intellectual property rights, defames others, or constitutes child sexual abuse material or other illegal content.
  • Use the Service to harass, threaten, or harm others.
  • Attempt to abuse, manipulate, or jailbreak the AI to bypass safety measures or generate prohibited content.
  • Scrape, crawl, or otherwise extract data from the Service through automated means.
  • Reverse-engineer, decompile, or attempt to extract the source code, model weights, prompts, or training data of any AI systems used by the Service.
  • Resell, sublicense, or provide the Service to third parties as a hosted service without our written permission.
  • Interfere with or disrupt the integrity, security, or performance of the Service.

We may suspend or terminate accounts that violate this section.

5. Your Content

This is the most important section of these Terms. Read it.

5.1 You own your work

You retain all ownership rights, including copyright, in the content you submit to the Service ("User Content") and in the creative works you produce using the Service. You can publish, sell, or license your work freely. You owe us no royalty. We make no claim of authorship and will not represent your work as our own. Your stories remain yours.

5.2 License you grant to us

So that we can run the Service and continue to improve it, you grant Perry Labs LLC a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to host, store, reproduce, modify, create derivative works from, and use User Content and AI-generated outputs for the following purposes:

  • (a) operating and providing the Service to you;
  • (b) improving, developing, and creating new features, products, and services;
  • (c) training, fine-tuning, evaluating, and developing machine learning and AI models, including models that may be used commercially or offered as products separate from the Service;
  • (d) providing content to third-party service providers (cloud hosting, AI model providers, analytics) so they can deliver and improve the Service;
  • (e) enforcing these Terms and complying with our legal obligations.

5.3 What this license is — and is not — in plain English

This license lets us improve the product and train AI on the kind of writing people actually do. It does not transfer ownership. It does not give us the right to publish your work as ours. It does not let us claim authorship. It does not stop you from publishing, selling, or licensing your work however you want.

5.4 How your content is used in training

When User Content is used for training, analytics, or product improvement, it is used as part of large aggregated datasets and is not associated with your name or account in resulting models. Trained models do not store or reproduce User Content as discrete, retrievable copies. The goal is to teach models patterns of good prose, structure, and editing — not to memorize anyone's manuscript.

5.5 Deletion

If you delete your account or specific content, we will remove that content from active systems within a reasonable period. However, content that has already been incorporated into trained or in-training models cannot be extracted from those models. The license in Section 5.2(c) survives deletion solely with respect to such already-incorporated material. Deleted content will not be used in any new training runs initiated after deletion.

5.6 Feedback

If you send us suggestions, feature ideas, bug reports, or other feedback about the Service, we may use that feedback freely without obligation to you.

6. AI-Generated Content Disclaimer

The Service uses AI models to generate suggestions, text, and other outputs. AI outputs are not guaranteed to be accurate, original, non-infringing, or appropriate for your purpose. They may contain errors, fabrications, or material that resembles existing works. You are responsible for reviewing, verifying, and deciding how to use any AI-generated output, including determining whether it is appropriate to publish or distribute. The Service is a writing tool; you are the author.

7. Subscription, Billing, and Refunds

The Service is offered on a subscription basis. Payments are processed by Stripe, our payment processor; your use of Stripe is subject to Stripe's terms. You authorize us to charge your chosen payment method on a recurring basis until you cancel.

You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period and you will not be charged again. Except where required by law, fees already paid are non-refundable. We may change pricing on prospective renewals with reasonable advance notice.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if your use creates legal or security risk, or if we discontinue the Service. On termination your right to use the Service ends; the provisions that by their nature should survive (including Sections 5, 9, 10, 11, 12, and 14) will survive termination.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability to you for any claims arising out of or related to the Service or these Terms is limited to the amount of fees you paid us in the twelve months immediately preceding the event giving rise to the claim.
  • We are not liable for any indirect, consequential, incidental, special, exemplary, or punitive damages, including lost profits, lost data, or loss of goodwill, even if we have been advised of the possibility of such damages.
  • You agree not to hold Perry Labs LLC, its owners, members, officers, employees, contractors, or affiliates personally liable for any amount beyond this cap.

Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the smallest amount permitted by law.

10. Mandatory Arbitration and Class Action Waiver

Read this section carefully. It affects your legal rights.

You and Perry Labs LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved exclusively through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, and not in court. The arbitration will be conducted in English, governed by the laws of the State of Wisconsin, and the seat of the arbitration will be Wisconsin (or another location agreed in writing). Judgment on the award may be entered in any court of competent jurisdiction.

Both parties waive the right to a jury trial. Both parties waive the right to participate in a class action, class arbitration, or any other consolidated or representative proceeding. Claims may be brought only in an individual capacity.

You may opt out of this arbitration agreement by sending written notice to support@fractalflow.ai within 30 days of first accepting these Terms.

Notwithstanding the above, either party may bring an individual action in small-claims court for disputes within that court's jurisdiction, or seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.

11. Indemnification

You agree to defend, indemnify, and hold harmless Perry Labs LLC and its owners, members, officers, employees, contractors, and affiliates from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. We do not warrant that AI outputs will be accurate, original, or suitable for your purpose.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you in advance through the Service or by email and update the "Last updated" date at the top of this page. If you continue to use the Service after the effective date, you accept the updated Terms. If you do not agree, you should stop using the Service.

14. Governing Law

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws rules. Subject to Section 10 (arbitration), the parties consent to the exclusive jurisdiction of the state and federal courts located in Wisconsin for any matter not subject to arbitration.

15. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and Perry Labs LLC regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
